Terms of Service

These terms govern use of the PrasuNova WhatsApp Business Platform service ("the Service"). By connecting a WhatsApp Business Account to the Service, or by sending messages through our API, you agree to them. "You" means the business using the Service.

What the Service is

PrasuNova is a Meta Tech Provider. We connect your WhatsApp Business Account to the WhatsApp Business Platform and provide an API for sending template, authentication, and service messages to your own customers, and for receiving message and status events back. We act on your behalf and under your instruction. We are not a party to your conversations with your customers.

Your responsibilities

• You are responsible for the content of every message sent through your account and for having a lawful basis to contact each recipient.
• You must obtain opt-in from recipients as required by the WhatsApp Business Messaging Policy and honour opt-outs promptly.
• You must comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, and Meta's platform terms. These apply to you directly, not only to us.
• You must keep your API credentials secret. Requests authenticated with your credentials are treated as made by you.
• You must not use the Service for spam, harassment, deception, or anything unlawful in the jurisdictions of you or your recipients.

Our responsibilities

• We use your Meta-issued access token only to operate the Service for you: sending the messages you request and routing your account's events back to you.
• We store that token encrypted at rest and do not share it with anyone.
• We handle your data as described in our Privacy Policy.

Suspension

We may suspend or terminate access if the Service is used in breach of these terms or of Meta's policies, if required by Meta, or if continued operation would put other users of the Service at risk. Where circumstances allow, we will tell you first.

Ending the relationship

You may stop using the Service at any time and disconnect our app from your WhatsApp Business Account. To have your stored data deleted, follow the Data Deletion Instructions.

Availability and liability

The Service depends on the WhatsApp Business Platform, which is operated by Meta and outside our control. We do not guarantee uninterrupted availability or the delivery of any individual message. To the extent permitted by law, our total liability arising from the Service is limited to the fees you paid us in the three months preceding the claim. Nothing here excludes liability that cannot lawfully be excluded.

Fees

Messaging charges set by Meta are passed through, together with any PrasuNova platform fee agreed with you in writing. Meta's pricing may change; changes take effect for you when they take effect for us.

Changes to these terms

We may update these terms. Material changes will be notified to the contact address on your account before they take effect. Continuing to use the Service after that constitutes acceptance.

Governing law

These terms are governed by the laws of India, and the courts of Rajasthan have exclusive jurisdiction over disputes arising from them.
